These Terms and Conditions set out the basis on which gardening services are provided by Gardeners Edgware. By making a booking, confirming a quotation, or allowing work to begin, you agree to these terms. They are intended to be fair, practical, and suitable for domestic and commercial gardening services delivered across our usual service area and surrounding locations.

1. About our services

Gardeners Edgware provides gardening and related outdoor maintenance services, which may include lawn care, hedge trimming, planting, weeding, border maintenance, seasonal tidying, pruning, clearance, soft landscaping, and other agreed garden tasks. The exact services to be carried out will be confirmed in the quotation, booking summary, or written agreement for the job.

We will use reasonable care and skill when carrying out the services. Unless otherwise agreed in writing, all services are provided on a one-off or scheduled basis according to the scope discussed at the time of booking. Any additional work requested on site may be charged separately and may affect the timing or completion of the original appointment.

2. Booking process

A booking is usually made after an enquiry, an initial discussion, and, where needed, a site visit or review of photographs and measurements. Any quotation provided is based on the information available at the time. If the garden condition, access, size, or scope of work differs from what was described, we may need to revise the quotation before work begins or adjust the service while on site.

A booking becomes confirmed only when we accept the requested date and time and, where applicable, receive any required deposit or advance payment. We may decline a booking if the work falls outside our capabilities, availability, safety standards, or normal service area. We will aim to attend within the agreed time window, but arrival times may vary due to traffic, weather, or earlier jobs running over.

The customer must ensure that access to the property and garden is available on the agreed date. This includes any keys, gate codes, parking arrangements, and other access details that are necessary for safe and efficient completion of the work. If access is not available, we may treat the appointment as a cancellation or a wasted visit and charge accordingly.

3. Quotes and estimates

Where a fixed price is offered, that price applies only to the work described in the quotation. Any estimate is based on the expected time and resources required and may change if the actual conditions differ from those described. Examples include overgrown areas, hidden obstructions, difficult access, excessive waste, or work that is more extensive than originally outlined.

We will normally discuss any material change in cost before continuing with additional work. If urgent safety issues arise, or if further work is needed to complete the job properly, we may proceed where reasonable and later charge for the extra labour, materials, or disposal involved.

4. Payments

Payment terms will be confirmed during booking or in the quotation. Unless otherwise agreed, invoices are due on completion of the work or within the period stated on the invoice. For larger projects, repeat visits, or recurring maintenance, we may request a deposit, staged payments, or payment in advance.

Accepted payment methods will be confirmed at the time of booking. If payment is not made by the due date, we may suspend further work, withhold future appointments, and recover any reasonable costs incurred in pursuing the unpaid sum. We reserve the right to charge interest and late payment fees where permitted by law and where this has been made clear in the invoice or agreement.

Any materials purchased specifically for the job remain chargeable, even if the work is later cancelled once the materials have been ordered or used. Prices may be subject to change if suppliers alter their charges or if the scope of the work changes after the quotation has been issued.

5. Cancellations and rescheduling

If you need to cancel or reschedule, please give as much notice as possible. We understand that plans change, but late cancellations can prevent us from offering the slot to another customer. If a booking is cancelled with short notice, or if we arrive and cannot complete the work because access is unavailable or the site is not ready, we may charge a cancellation fee or a wasted visit fee.

Where a deposit has been taken, it may be retained in full or in part to cover lost time, administration, and any costs already incurred. If we need to cancel due to severe weather, unsafe conditions, illness, equipment failure, or other factors beyond our reasonable control, we will contact you as soon as practicable and arrange a new date where possible. In such cases, no cancellation charge will usually apply.

Repeat or scheduled maintenance visits may be paused or amended by either party with reasonable notice. If recurring work is cancelled permanently, you remain responsible for any work already completed and any non-refundable costs associated with the booking.

6. Customer responsibilities

You are responsible for ensuring the garden and property are reasonably prepared for the agreed services. This includes removing or securing valuables, moving small fragile items, keeping pets and children away from work areas, and informing us of any hazards, underground services, hidden features, restricted access, or special instructions before work begins.

If we identify unsafe conditions, protected plants, nesting wildlife, unstable structures, or items that could be damaged by the work, we may pause or modify the service. We are not responsible for loss or damage caused by failure to disclose relevant information, by defective property conditions, or by instructions given by the customer that conflict with safe working practices.

7. Liability and limitations

We will take reasonable care when working on your property, but gardening involves inherent risks, including accidental disturbance of plants, soil, surfaces, fixtures, and buried or hidden items. To the extent permitted by law, we are not liable for indirect or consequential loss, loss of enjoyment, loss of business, or loss arising from events outside our control.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited under UK law. If we are found responsible for damage or loss, our liability will be limited to the reasonable cost of repair or replacement, or the value of the relevant service charge, whichever is lower, except where the law requires otherwise.

We are not liable for pre-existing damage, natural wear and tear, defects in lawns, plants, paving, fences, irrigation systems, or garden structures, or damage caused by poor maintenance before our attendance. We also do not accept responsibility for plant failures due to weather, pests, disease, seasonal conditions, watering issues, or factors outside our control unless we expressly agreed to a specific plant-care outcome in writing.

8. Waste, green waste, and disposal regulations

Where waste removal is included as part of the service, it will be handled in a lawful and environmentally responsible manner. Green waste may include grass cuttings, hedge trimmings, leaves, weeds, branches, and similar garden materials. Other waste such as soil, rubble, broken pots, timber, or contaminated materials may require separate handling and may not be accepted as part of standard garden waste collection.

You must tell us in advance if the waste includes items that are hazardous, sharp, contaminated, bulky, or subject to special disposal rules. This includes chemicals, asbestos, oils, fuel, paint, treated timber, animal waste, and any material that may be regulated or require specialist disposal. We may refuse to handle waste that cannot be lawfully transported or disposed of under applicable regulations.

Unless otherwise agreed, any waste removed from your property becomes our responsibility only once it has been accepted for collection as part of the agreed service. If waste disposal charges, recycling fees, or tip fees apply, these may be added to the invoice. You remain responsible for the accuracy of any information you provide about the nature and quantity of waste. We reserve the right to charge additional fees if the actual waste load differs materially from what was described at booking.

9. Materials, plants, and third-party products

If we supply plants, compost, turf, mulch, or other materials, we will use reasonable care in sourcing them. However, natural products vary in quality and appearance, and no guarantee can be given that living materials will always establish successfully. Any advice given about aftercare, watering, feeding, or maintenance should be followed to improve results.

Where products are supplied by third parties or selected by the customer, we accept no responsibility for defects, shortages, or manufacturer issues beyond any rights that may be available under law. Any warranties or guarantees provided by manufacturers or suppliers will apply in addition to your statutory rights, where relevant.

10. Complaints and service issues

If you are unhappy with any aspect of the service, please raise the issue as soon as possible so that we can review it promptly. We may ask for photographs or additional details to help assess the matter. If a service issue is confirmed, we may offer to return and put matters right, provide a partial refund, or agree another reasonable solution depending on the circumstances.

We will not be responsible for issues that arise because the garden was not maintained after our visit, because of adverse weather, or because instructions were changed after work had been completed. Any complaint should be made within a reasonable time after the service date so that the matter can be investigated properly.

11. Events beyond our control

We will not be liable for any delay or failure to perform our obligations where this is caused by events beyond our reasonable control. These may include extreme weather, flooding, fire, illness, road closures, accidents, supply shortages, strikes, or interruptions to utilities. If such an event occurs, we will try to rearrange the service as soon as reasonably possible.

12. Changes to these terms

We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal requirements. The version in force at the time of your booking will normally apply to that booking unless a newer version has been expressly agreed in writing. Continued use of our services after any update means you accept the revised terms.

13. Governing law

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or connected with them, or with the services provided by Gardeners Edgware, will be subject to the exclusive jurisdiction of the courts of England and Wales.

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. No failure or delay by either party in enforcing any right under these terms shall operate as a waiver of that right.

By confirming a booking or allowing work to proceed, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
